1. Who we are
BiodiComply SA (Pty) Ltd, Registration No. 2026/657687/07, 72 Gordon Avenue, Linbro Park, Sandton, 2196, South Africa ("BiodiComply", "we", "us"). By creating an account or buying credits you agree to these terms.
2. What the service does
BiodiComply is a permit checker. You tell us about a plant species, your province and what you plan to do with it (for example cultivate, grow, sell or transport it). We return general guidance on whether permits under NEMBA, CARA or related regulations may be needed, and who to contact.
This is general guidance, not legal advice. Rules change and your situation may differ. Always confirm with the Department of Forestry, Fisheries and the Environment (DFFE), your provincial department of agriculture or a qualified adviser before you act on a result. You remain responsible for complying with the law.
3. Your account
You sign in with your mobile number and a PIN. You can use the website or our WhatsApp service. Keep your PIN private. You are responsible for activity on your account. You must be 18 or older, or have a parent or guardian's permission.
4. Credits and prices
- Checks are paid for with credits. The credit cost of each check is shown before you confirm it.
- 1 credit = R50. Bundles: 10 credits for R450, 50 credits for R2,000.
- Prices are in South African Rand (ZAR).
- Credits belong to your account. They cannot be transferred, exchanged for cash or sold.
- If a check cannot be completed because of an error on our side, the credits are returned to your balance automatically.
5. Payment
Depending on what is available when you buy, you can pay:
- By card or instant EFT through PayFast (a service of Network International). Credits are added once PayFast confirms the payment, usually within a minute.
- By instant EFT or PayShap through Ozow. Credits are added once Ozow confirms the payment, usually within a minute.
- By bank transfer or PayShap to our bank account. Use the exact payment reference we show you. We add the credits after we see the payment in our account, usually within one business day.
Your card or bank login details are entered only on the payment provider's or your bank's secure pages and are never seen or stored by us.
6. Refunds
See our Refund and Cancellation Policy.
7. Acceptable use
Do not misuse the service: no attempts to break into or overload it, no automated scraping, no sharing of your account to resell checks, and no unlawful use of the results.
8. Availability and accuracy
We work to keep the service running and the information current, but we do not promise it will be uninterrupted or error-free. Our data comes from public regulations and official contact lists, and may be incomplete or out of date.
9. Limitation of liability
To the extent the law allows, we are not liable for losses that result from relying on a result without checking it with the relevant authority, or from interruptions outside our control. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim. Nothing in these terms limits your rights under the Consumer Protection Act or any other law that cannot be limited by agreement.
10. Changes
We may update these terms. The date at the top shows the latest version. If you keep using the service after a change, you accept the new terms. Credits you have already bought keep the value they were bought at.
11. Law and disputes
These terms are governed by the laws of South Africa. Please contact us first at our contact page so we can try to resolve a problem. You may also approach the National Consumer Commission or the courts of South Africa.
